The scope of this course is comprised of the definition of law, its connection with and difference from other rules of social order, its values, the characteristics of the rule of law, the enforcement of the rule of law, and the concepts of right and sanction.
HUK 102	Theory of Law	2 Credits	-
Within the scope of this course; the emergence of the rules of law, the configuration and evolution of the same, the fundamental concepts and institutions of law and the streams of law are examined, and the interaction between the natural law and positive law is addressed.
HUK 103	Civil Law I	4 Credits	-
The scope of the course contains the fundamental concepts of Civil Law as well as the preliminary provisions of Turkish Civil Code and the Law of Persons. Particularly the enforcement of the rules of law, interpretation and gap-filling, judicial discretion, the concept of right, gaining and forfeiture of rights, the rule of integrity and the good faith are examined within the context of the fundamental concepts of Civil Law and the preliminary provisions of Turkish Civil Code; and particularly the natural persons and legal entities, the capacities, the personal right and the retention of personality, the associations and the foundations are examination within the context of the Law of Persons.
HUK 104	Civil Law II	4 Credits	-
The course is about the Family Law and its scope is comprised of three sections line parallel to the systematics of Turkish Civil Code. The first section regarding marriage addresses engagement, marriage, the general provisions of marriage, the protection of marriage, nullity of marriage and divorcement, and marital property, while the second section addresses particularly the ways of establishment of paternity, the guardianship, and the third section addresses the trusteeship, the curatorship and the legal advice (consultancy).
HUK 105	Constitutional Law I	4 Credits	-
The scope of this course examines the concept of constitution, the types of constitution and movements of constitutionalizm, the processes of establishment and amendment of constitutions, the political power, the state and the forms of state. Subsequently addressed and discussed are the the normative characteristics of the legal order, the models of auditing the compliance of acts, laws and codes to the constitution, the political systems and democracy, the principle of separation of powers, the government systems and the fundamental rights and freedoms.
HUK 106	Constitutional Law II	3 Credits	-
Addressed and discussed within the the scope of this course are the established power within the framework of the historical development of Turkish Constitutional Law and the Constitution of 1982, and within the scope of the same, the legislative organ and its functions as well as the other state functions and actions, the organization of the legislative organ, the legal status and the exemptions (immunities) of the members of the legislative organ and the legislative actions. Within the context of legislative actions are addressed and discussed the laws and the acts of the parliament as well as the legislative process, and the executive organ and its actions, particularly the legislative decrees in normal state and state of emergency are examined. Within the context of the judicial organ are lectured the judicial organ in the light of the rule of law, the Constitutional Court, the review of norms and individual application, and the characteristics of the decisions of the Constitutional Court. Finally, the basic characteristics of the Republic are deliberated.
HUK 109	Legal English I	2 Credits	-
Legal English contains a number of specialized features when compared to standard English. For this reason, students need to learn these features to be able to use English in their professions. This course aims to provide students with the fundamental principles of Legal English.
HUK 110	Legal English II	2 Credits	-
As the follow-up course of Legal English-I this course also contains the features of Legal English and aims to provide students with the fundamental principles of Legal English.
HUK 113	Roman Law I	2 Credits	-
The scope of this course is comprised of the political, social and economic events that shaped the formation of Roman law, the law-creating organs of Rome, the methods of reasoning employed, the principles of law used by Roman jurists in the resolution of a legal dispute, and the construction activities by Roman jurists in balancing legal interests; the capacity to have rights and its conditions in Roman law, the concept of legal act, the capacity for legal act and its conditions as well as the nullity of legal acts.
HUK 114	Roman Law II	2 Credits	-
The scope of this course is comprised of the protection of rights in Roman law and, in that sense, the special judicial system and extra-system process as well as the concepts, rules, principles and institutions in Roman law of obligations and of property.
HUK 116	General Public Law	2 Credits	-
This course analyzes the concepts such as the state, the power and the legitimacy as well as the elements and development of the state, the individual - state relations, the qualities of the political power, the problem of limitation of the political power, the role of the law in the individual-state-society relations, the purpose of limitation of the political power and the importance of the same in terms of rights and freedoms.
HUK 118	International Human Rights Law	4 Credits	-
This course analyzes the international and domestic laws and institutions that protect the fundamental rights of al human beigns. The course also describes and evaluates the principal mechanisms and strategies for holding governments accountable for violating those rights.
HUK 201	Law of Obligations I	3 Credits	-
Addressed, discussed and analyzed within the scope of Law of Obligations I are the subject matter and the historical foundations of the law of obligations, the principles governing the law of obligations, the fundamental concepts of the law of obligations such as the obligation, the debtor-creditor relation, the parties to the debtor-creditor relation and the liabilities that arise out of the debtor-creditor relation. Also analyzed are the concept and types of legal act, the freedom of will and the limits of the same, the concept of contract, the establishment of the same, general conditions of act, nullity in legal acts and representation.
HUK 202	Law of Obligations II	3 Credits	-
The scope of Law of Obligations II, is comprised of the forms of the debtor-creditor relation that arise out of tort, unjustified enrichment and acting without authority. Particularly addressed, analyzed and discussed within the scope of tort are the elements of tort, the facts of no-fault liability, and in that context, the ordinary absolute liability, the strict liability and the equity liability as well as the liability that arises out of lawful intervention. The scope of this course also encompasses joint and several liability and the termination of obligations and obligatios.
HUK 203	Criminal Law I	3 Credits	-
The course is comprised of two sections in line with the systematics of Turkish Criminal Code. In introduction to criminal law; the fundamental concepts, the sources of criminal law and the fundamental principles of the crime policy are analyzed. In crime theory, being the second section; the material and moral elements of crime and the element of unlawfulness are addressed and discussed.

Within the scope of this course, being the continuation of Criminal Law I; the concepts of criminal attempt, complicity and consolidation as well as the theory of sanctions and the enforcement of criminal codes in terms of location, time and person.
HUK 205	Administrative Law I	3 Credits	-
In Administrative Law I, meaning the law of administration in the broadest sense; the concept of administration, the main meanings of state administration (conduct of state), being the subject matter of administrative law, and the administrative function are deliberated, primarily. Also deliberated are the main principles and systems that have affected the emergence of administration, the sources of law that are binding on administration, the emergence, development and the characteristics of administrative law as well as the administrative organization of Turkey, the administrative acts and the powers of regulation, sanction enforcement and property acquisition of administration.
HUK 206	Administrative Law II	3 Credits	-
Within the scope of this course, being the continuation of Administrative Law I; the administrative contracts within the framework of the functioning of administration, the scope of activity of the administration and the financial liability of the same as well as the public officials and the civil service are addressed and discussed.
HUK 208	Human Rights Law	2 Credits	-
The concept of human rights, the individual - state relation in terms of human rights and the question of freedom, the protection of human rights at national and international levels, the course and development of human rights in Turkey, the European Convention on Human Rights, which is the most important instrument on human rights, to which Turkey is a party, and the main practices of the European Court of Human Rights, which has been established by the aforesaid Convention, are analyzed.
HUK 209	Sociology of Law	3 Credits	-
The importance of the law for the society, the interaction between the law and the society, the rules of law that change in parallel to the development of societies, and the inter-relation between the concept of society and the concept of law are analyzed. Also, the opinions regarding the law of such founders as Montesquieu, Durkheim, Marx, Max Weber and Gurvitch are addressed and deliberated on the basis of such questions as the sociological origin, the effectiveness, the function and the historical evolution of law.
HUK 210	Philosophy of Law	3 Credits	-
In this course; the definition and the objective of the law, the question of cognizance and freedom of will in law, the characteristics of the legal order, the concepts of right, justice and equality are analyzed within the context of the theories of the stream of natural law, the historical school of jurists, legal positivism and legal realism.
HUK 211	International Law	3 Credits	-
In this course; the history, the development, the fundamental principles and the similarities to and the differences from the domestic law of international public law are analyzed, primarily, and the sources of international public law, primarily including the international law of treaties and the international customary law, are addressed and deliberated. Also, the parties of the international law and their respective positions and roles within the order of international law are also analyzed within the scope of the course. Ultimately; the rules of the international law related to substantive law such as the maritime law, the air law, the space law, the human rights law, the international criminal law and the international economic law.
HUK 212	Commercial Law I	3 Credits	-
The scope of the Commercial Law I is comprised of the concepts of commercial enterprise, the commercial affairs and the provisions that govern the same, the commercial provisions, the commercial jurisdiction, the merchant, the effects and the consequences of being a merchant, the merchant assistants, the trade registry, the trade name and the trade name, the trade name, the unfair competition, the commercial books and the current account.
HUK 215	International Law I	4 Credits	-
This course introduces students to public international law. The course provides a general introduction to the fundamental principles of public international law and the nature, structures and institutions of the international legal system. It analyses, in detail, the sources of international law, such as treaties, international customary law and general principles of law. Then, the subjects of international law, i.e. States, international organizations and non-states actors, and their role in the international scene are thoroughly examined. The relationship and interaction between international legal system and national legal orders also constitute one of the basic subjects that will be elaborated on in this course.

This course is comprised of a systematic explanation of the substantive norms specifically regulating various fields of public international law. In the framework of this course, the basic concepts and principles of the norms on State, law of the sea, air law, space law, international economic law, international space law, international environmental law, law of international relations, law of armed conflicts, international criminal law are examined.
HUK 217	Sociology of Law	4 Credits	-
This course examines the importance of law within society, the interaction between law and society, and the norms of law that change according to the development of society, the relationship between law and society. On the basis of the issues such as social basis, effectivenes, social functions and historical development of law, the sociological approaches of Montesquieu, Durkheim, Marx, Max Weber, Gurvitch to law are explained.
HUK 218	Philosophy of Law	4 Credits	-
This course examines the concept, source and the purpose of law, the issues of judgement and freedom of will in law, characteristics of legal system, the concepts of right, justice and equality in the context of theories such as natural law, historical school of law, legal positivism and legal realism.
HUK 301	Obstacles to Performance and Law of Contracts I	3 Credits	-
In this course, the concept of performance and the elements of the same are analyzed, following which the obstacles to performance are addressed and deliberated. In this context; particularly the defective performance, the default of creditor and debtor, the impracticability, and the violation of the protection and ancillary clauses. Also addressed and deliberated are the effects on third parties of debtor-creditor relations, special cases in debtor-creditor relations and substitution of parties.
HUK 302	Obstacles to Performance and Law of Contracts II	3 Credits	-
In this course; sale contracts, donation contracts, lease contracts, contracts of work, contracts of mandate, contracts of surety, which are regulated within the special debtor-creditor relations section of Turkish Code of Obligations, are analyzed. In this scope are addressed and deliberated the characteristics of the creditor's default, the debtor's default, the impracticability of subsequent performance, failure in due performance and hardship, and innominate contracts and the provisions applicable to innominate contracts are analyzed.
HUK 303	Law of Property I	3 Credits	-
In this course; the concept of real right, the concept of property, the principles governing the law of property, the possession, and in the context of possession, particularly the kinds of possession, acquisition of possession and the forfeiture of the same, the termination of possession, the retention of possession, the presumptions of possession, the land registry, and in the context of land registry, particularly the elements of land registry, registration, annotations and declarations, the acquisition of real rights by reliance on the land registry, the responsibility of the State to keep land registry records and the correction of land registry details are addressed and deliberated.
HUK 304	Law of Property II	3 Credits	-
In this course; the right of property and the limited real rights are analyzed. In that context; the acquisition by persons of the right of property over the elements of property, the scope of the same, the restrictions over the same, the common ownership, the joint ownership, property ownership, the liability of real estate owner, easement connected to property, the right of usufruct, the rights of usufruct such as the right of construction and the right of source, and the principles governing the real property pledge, the mortgage, the scope of mortgage, the types of the same, the system of fixed degrees, the pledge of movable property assets and the pledge of claim are addressed and deliberated.
HUK 305	Commercial Law II	4 Credits	-
The scope of this course is comprised of the unincorporated company, the general provisions on trading companies, the establishment of the same, internal and external relations in companies, the basic structures of companies, the shareholders, the bodies of companies, the liability and the liquidation.
HUK 306	Specific Provisions of Criminal Law	3 Credits	-
In this course, which addresses and analyzes the types of offense defined and provided by the Criminal Code; the material and the moral elements of specific types of offense are analyzed under the main headings of the offenses against persons, the offenses against the society, the offenses against the state and the nation, and the aggravating or mitigating causes defined and contemplated by the Code for each type of offense are addressed and deliberated.
HUK 307	Law of Civil Procedure I	3 Credits	-
In this course; the fundamental concepts of the law of civil procedure, the application in terms of location and time of the rules of the law of civil procedure, the judicial officials, the court organization and the duties and powers of courts, the principals governing judicial process, the time frames, the parties in legal cases and matters related to the same, attorneyship, conditions of action, filing of lawsuits (legal actions), the elements of bills of claims and bills of answers, preliminary review, and generally investigation and arraignment are analyzed.
HUK 308	Law of Civil Procedure II	3 Credits	-
In this course; the general provisions regarding proof and evidence (burden of proof and exclusions related to the same, the right of proof etc.), the production of evidence, the types of conclusive and discretionary evidence (proofs), the decisions instituted by the courts, the prejudicial question, intervention, amendment of pleading, joinder of parties, warrant and the actions of the party, who terminates the case. Also addressed and deliberated are legal protections, specifically injunctive reliefs and generally legal remedies (appeal, retrial) as well as definitive judgment, arbitration and alternate ways of resolution of disputes.
HUK 309	Administrative Jurisdiction	2 Credits	-
In this course; the fundamental principles of administrative procedure and the characteristics of the same, organization and field of duties of administrative jurisdiction in Turkey, the types of administrative cases and administrative remedies are addressed and deliberated.
HUK 310	Tax Law I	2 Credits	-
This course analyzed the Constitutional principles of taxation, the enforcement of tax codes in terms of location, time and meaning, the taxpayers and liable parties and the taxatio process.
HUK 312	Intellectual Property Law	4 Credits	-
This course examines the main principles of intellectual property law. In this concept, in the first part of the course, the definitions and types of intellectual property, international agreements on this issue, infringement and legal protection mechanisms of intellectual property are analyzed. After this general framework, trademark law and its main topics such as registering, termination, usage breach of trademark rights and it’s protection mechanisms are refered. Finally patent law and its main principles and consequences including an analysis of industrial designs are examined.
HUK 313	Law of European Union	3 Credits	-
This course examines the establishment and historical development of the European Union and gives general information on European Union Law. Furthermore, it explains the jurisdiction and sphere of effect of the European Union Law, institutions of the European Union, sources of the European Union Law and the relations between the European Union Law and national laws of the member states.
HUK 401	Law of Commercial Papers	3 Credits	-
The scope of this course is comprised of the fundamental concepts related to commercial papers, registered notes, promissory notes and bearer's notes, bills of exchange (policy, bill, check) and conflict of laws.
HUK 402	Law of Inheritance	3 Credits	-
In this course; the persons, by whom the property assets of a person are to be inherited in the event of the death of the owner of such assets, and the conditions governing such inheritance, and specifically legal and inheritors with reserved portion, causa mortis actions and the forms of the same, reduction of causa mortis and inter vivos entitlements, offsetting in inheritance are analyzed.
HUK 403	Law of Criminal Procedure I	3 Credits	-
In this course; the principles that govern the criminal procedure such as the right to fair trial, the presumption of innocence, the publicity of criminal procedure, the notification of criminal charge, the equality of arms principle and benefit of the doubt for the defendant, and the duties of judges and prosecutors through the course of trial process are analyzed.
HUK 404	Law of Criminal Procedure II	3 Credits	-
In this course; the proof in criminal procedure and the phases of investigation and prosecution are analyzed, and the measures of protection such as apprehension, search, seizure, arrest and judicial control as well as the settlement and remedies in criminal procedure are addressed and deliberated.
HUK 405	Enforcement Law	3 Credits	-
In this course; the fundamental concepts related to the enforcement law, the types of proceedings, proceeding without judgment, general lien and in that context, the phases of proceeding (request to issue enforcement proceedings, payment order and finalization of the same, sequestration, sale and allocation of proceedings), remedy of sequestration in respect of bills of exchange, eviction of leased real estates by way of enforcement without judgment, enforcement with judgment and the types of the same, proceeding by way of liquidation of pledge and the characteristics of the same, precautionary attachment and actions for rescission of disposition are analyzed.
HUK 406	Methodology of Law	3 Credits	-
The methodology of law is the discipline that studies and explains the method to be followed in the enforcement of law. For this purpose; specifically the construction of laws, verbal, teleological, historical, systematic, Constitutional construction, creation of law by judge, the concept of gap, the types of concealed and intra-legem gaps, the methods and procedures of filling gaps, and the creation of law in excess of the acts and codes are addressed and deliberated through ensuring the students' participation by way of preliminary preparation and presentation by students of the practices related to the course. In this context, also analyzed are the legal dogmatics as a normative discipline, the logical structure of the rule of law and the elements of the same, the sequence of logic in the enforcement of acts and codes, and the occurrence and legal assessment of the event that is the subject matter of a legal question.
HUK 407	Labor Law	3 Credits	-
In this course; the definition of labor law, its characteristics, sources, the concepts of employee, employer and workplace, the scope of applicability of the labor law, the concept and types of employment contract, the establishment of employment contract and the rights granted and the obligations imposed by the same to the respective parties, the general and special causes of termination of employment contract, the concept of employment security, the legal consequences of the termination of employment contract, work times of employee and arrangement of the same, occupational safety and health and occupational safety supervision activities are analyzed.
HUK 408	International Private Law	3 Credits	-
The scope of this course is comprised of the conflict of laws and the international law of procedure. In that scope; the basic questions of the conflict of laws, the law applicable for the disputes that arise out of the private law relations of foreign parties, the international jurisdiction of Turkish courts and the recognition of the decisions of foreign courts are analyzed within the framework of the Code on the International Private Law and Law of Procedure and the relevant international conventions.
HUK 411	Tax Law II	2 Credits	-
In this course; the phases of assessment, notification, accrual and collection, which constitute the taxation process are, analyzed through the administrative law perspective. Subsequently, tax-related misdemeanors and offenses and the administrative and judicial settlements of tax disputes are addressed and deliberated.
HUK 412	Law of International Sale of Goods	4 Credits	-
This course introduces students to the application of international sale contracts. In the scope of the course, the international codification called Convention on Contracts fort he International Sale of Goods (CISG) is analyzed. In this context application of CISG and rights and obligations of the parties are examined. In addition to CISG other obligatory codifications and soft law materials are also evaluated in comparison with Turkish law.

Electives

The elective courses at the Faculty of Law are designed to enable students’ specialization in accordance with their areas of interest. Having received the pillars on fundamental topics, the students are then offered groups of electives as packages to enable their specialization in their areas of interest, from the third year on. The electives are offered under three groups: international law, economic law, and public law. The list of elective courses on offer with reference to specific topics may vary from time to time.
The students are required to select just one such module. Once selected, transfers between specialization fields are not allowed.
To graduate from the Faculty of Law, the students should take and pass eight electives on offer in the selected module, as well as another elective on offer university-wide.
The electives shall be offered in accordance with the demand voiced by the students. For a course to be opened, at least five students should register for it. The students who registered for an elective which did not get to be opened due to lack of interest will be allowed to elect other courses which may still be opened.
The elective courses are worth at least 2 credits. The students can choose an elective with a higher credit count as well.

This course interprets legal documents, teaches legal terminology and writing styles used in legal documents, gives an understanding how to interpret and apply legal arguments made, and logical reasoning translated into legal argument.
HUK 214	Legal English IV	1 Credits	-
This course covers legal document drafting techniques, persuasive and non-persuasive writing, structure of legal memoranda, motion and discovery writing, use of legal terminology in writing, exressing legal logic in English.
HUK 311	Turkish Legal History	2 Credits	-
In this course; Turkish law prior to Islam, Turkish law after the acceptance of Islam, particularly the sources of Islamic law, the sects, Islamic public law, Islamic private law, the law in and the judicial organization of the Ottoman Empire until the declaration of the Imperial Edict of Gulhane, and the development of Turkish law after the declaration of the Imperial Edict of Gulhane.
HUK 321	European Union Law	2 Credits	-
The fundamental legal system of the Union, which is shaped by the agreements between and among the member states, the regulatory instruments such as regulations and directives, which are issued by the competent bodies of the Union, and the resolutions adopted by the Union, is analyzed, and the elements that constitute the system are addressed and deliberated, and the effects of the European Union Law on the member states are discussed within the scope of this course.
HUK 322	EU Law and EU Policies	2 Credits	-
This course covers general principles of the EU law, primary and secondary resources, EU structural and functional institutions and institutional principles, structure of the European Communities Court of Justice, the Rome Treaty and the new constitution for EU.
HUK 323	International Organizations	2 Credits	-
The historical background and the development of international organizations, the common characteristics of international organizations, and the general structure and the position within the international law of the same are analyzed within the scope of this course. The structures and the functioning of such organizations as the United Nations, the European Union, the Council of Europe, the International Labor Organization, the North Atlantic Treaty Organization, the World Trade Organization, the International Monetary Fund, which have been established by states or by non-governmental organizations, and which are engaged in activities at international level, are addressed and deliberated. Furthermore; the characteristics of such entities as the International Committee of Red Cross, Fédération Internationale de Football Association are also discussed within the scope of this course.
HUK 324	International Transport Law	2 Credits	-
In this course; the concept of transportation work, head end business, moving property transportation, transportation via various vehicles, passenger transportation and freight forwarder are analyzed. Also addressed and deliberated are road transportation, air, marine and railway transportation in comparison with CMR (Convention on the Contract for the International Carriage of Goods by Road), the definition and elements of transportation (carriage) contracts, the parties of transportation (carriage) contracts, the principal carrier, the actual carrier, the waybill and the cases of liability in transportation works.
HUK 325	American Contract Law	2 Credits	-
This course is a basic introductory course in contract law which covers the bases for enforcing promises, the bargaining process, including pre-contractual liability, the requirement of a writing (statute of frauds), policing bargains for unfairness, remedies for breach of contract, mistake, and unexpected circumstances.
HUK 326	Intellectual and Industrial Property Law	2 Credits	-
In this course; the fundamental principles of the intellectual property law, the definition and types of the intellectual property, the international treaties in the field, the infringement of the right of intellectual property and the measures for the protection of such right are addressed and deliberated. Subsequently; trademark law and in that sense, trademark registration, de-registration, use of trademarks, infringement of trademark right and methods of protection are analyzed, and also, the fundamental principles of patent law and the comparison of patent right with the right to industrial designs are addressed and deliberated.
HUK 327	Protection of Personal Data	2 Credits	-
In this course; the concept of personal data, the question of the protection of personal data, the definition of personal data and sensitive data, the legal nature of personal data, the protection of personal data and the protection facilities are analyzed.
HUK 328	Contracts of Market Release	2 Credits	-
Agency, exclusive distribution and franchise contracts, being the Contracts of Market Release, are analyzed in this course.
HUK 329	Legal Ethics	2 Credits	-
The relation between the law and the ethics, the basic similarities and points of difference of such concepts as well as the concepts of justice, ethics and value are addressed and deliberated.
HUK 330	Zoning Law	2 Credits	-
The place and importance of the zoning law among other branches of law, the legislations about zoning, the zoning plans and the related principles, the structures and the principles regarding structures, the zoning liabilities and sanctions, the building inspection and judicial review are addressed and deliberated.
HUK 331	Banking Law	2 Credits	-
The concept of banking and the historical development of the same, the objective and the general systematics of the Banking Act, the concept of loan (credit) and the types of the same, the parties to and the legal consequence of loan contracts, real and personal securities for loans, surety and guarantee contracts, the concept of letter of guarantee, letters of credit and the types of the same, the concept of saving, and banking secrets and the protection of the same are analyzed.
HUK 332	Capital Market Law	2 Credits	-
The financial markets and the capital market law are addressed and deliberated in broad strokes; and the concept of capital market as a part of the financial markets, the infrastructure of the capital market law that is in force in Turkey and the capital market instruments, activities and actors, manipulation, insider trading, related party transactions and the sanctions imposed for such acts and actions are analyzed.
HUK 333	Economic Analysis of Law	2 Credits	-
In this course; the historical development of the economic analysis theory, the positive and normative concepts of economic analysis, the assessment of legal relations through economic perspective, the economic basis and effects of legal sanctions, the concepts of efficient breach and economic efficiency, the priority of efficiency in apportionment and the economy of the legal process are addressed and deliberated.
HUK 334	Environmental Law	2 Credits	-

In that regards; theoretical and conceptual comparisons are made in respect of the types of constitutions, the fundamental rights and freedoms and the government systems, and the implications of such concepts and institutions within the framework of comparative law are discussed.

In this course; the development of the law of political parties in Turkey, the functions of political parties, and the goals, structure and functioning of political parties within the framework of the Constitution and the Political Parties Act are analyzed. Also addressed and deliberated are the prohibitions to be observed by political parties within the framework of the Political Parties Act and the relevant established case practices of the Constitutional Court and the European Court of Human Rights. In this course; the scope and the wording of the European Convention on Human Rights and the protocols annexed to the same, the nature and the enforcement by the contracting states of the established case practices of the European Court of Human Rights that constitute the basis of the control mechanism of the Convention, the supervision by the Committee of Ministers of the European Council in respect of the enforcement of the Court's decisions and the effects on Turkish domestic law of the Court's decisions.

This course covers the fundamental matters related to the international commercial arbitration. In that scope; general information about arbitration is provided, following which arbitration agreement, arbitration procedure, applicable law, abitrator's award and the recognition of foreign arbitration awards are analyzed.

In this course; the efforts for uniformization related to international sales, the scope of applicability of the United Nations Vienna Convention on Contracts for the International Sale of Goods, the general principles regarding the filling of the gaps within the wording of the Convention and the provisions regarding the institution of relevant contracts, the system of obstacles to performance within the provisions of the Convention, the actions in breach of the contract and the consequences of the same, such concepts as indemnification, interest etc. and facilities of relief from liability are analyzed.

The concept of alternative dispute resolution and the historical development of the same, the field of application of alternative dispute resolution, the relation of the same with the state jurisdiction and the arbitration, and the alternative dispute resolution methods are analyzed. Also addressed and deliberated within the course are the concept of mediation and the relation of the same with similar concepts, the disputes that are eligible for mediation, and the initiation, continuance and ending of the mediation process within the framework of the Code on Mediation in Legal Disputes, the fundamental principles that govern the said code, the course of the mediation process, the rights and teh obligations of mediator, the conclusion of the mediation activity, the characteristics and the execution of the formal record issued upon the completion of the mediation activity.

Rules Regarding Elective Courses:

1-) Each student, who attends the 30% English Program of the Faculty of Law must successfully pass elective courses lectured in English that correspond to at least 9 credits in total.
2-) Each students of the Faculty of Law, who enrolls for the undergraduate program as of the Academic Year of 2016-2017, are obliged to successfully pass 6 elective courses, each of which corresponds to minimum two credits, in addition to the University Elective Courses.
